Information Bulletin - Pre-Hearing Dispute Resolution Conference
March 27, 2009
Pre-Hearing Dispute Resolution Conferences are the first step in an application (unless the parties request that their matter go directly to mediation). The purpose of the conference is to discuss the issues, evidence, and likelihood of resolution, then set the next steps.

Guidelines
Guidelines connote general statements of principles of the Land Compensation Board.

These principles are non-binding statements intended to inform and guide those subject to actions under the relevant legislation.

Guidelines of this nature do not require specific statutory authority. They are intended to provide guidance to the public and to the Board.

The Board intends to review all guidelines annually (or sooner if required). Comments regarding the guidelines are invited and will be considered in the review.


The Land Compensation Board (LCB) is a quasi-judicial board authorized under the Expropriation Act to establish compensation when private land is expropriated by a public authority for projects in the public interest.
 
Parties are encouraged to use mediation as the primary way to resolve disputes that come before the Board. Unlike a formal hearing, the parties have control over the outcome and are more likely to be satisfied with mediated results than with decisions imposed by the Board.
